OFB Terms & Conditions

These Terms & Conditions are entered into between Online Fitness Bootcamp Limited ("OFB", "we", "us", "our") and you ("user", "member", "you").

By accessing the OFB website, creating an account, registering for a membership, purchasing a product, or using OFB content, you agree to these Terms & Conditions.

1. Use of the Website

You may use the OFB website and services only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the website for illegal, harmful, abusive, or misleading purposes.
• Attempt to interfere with website security, hosting, software, or functionality.
• Copy, scrape, resell, or redistribute OFB content without permission.
• Use another person’s account without permission.
• Upload malicious code, spam, or harmful material.
• Misrepresent yourself or your connection to OFB.

2. Memberships

OFB may offer free memberships, paid memberships, challenges, courses, downloads, training programs, affiliate access, or other services.

Membership access may vary depending on your membership level.

OFB may change, add, remove, or update membership features, content, access rules, or program structure at any time.

3. Account Responsibility

You are responsible for maintaining the security of your account, username, password, and login details.

You agree not to share your account access with other people.

If OFB reasonably believes an account is being shared, abused, misused, or accessed improperly, OFB may suspend or terminate access.

4. Payments, Billing, and Renewals

Paid memberships may be billed on a recurring basis unless otherwise stated at checkout.

By purchasing a paid membership, you authorise OFB and its payment providers to charge the applicable membership fee at the stated interval.

Prices are listed in New Zealand dollars unless otherwise stated.

If a payment fails, access may be suspended or cancelled until payment is successfully completed.

5. Cancellations

You may cancel your membership at any time through your account area or by contacting OFB.

Cancelling a membership stops future billing. Access may continue until the end of the paid billing period unless otherwise stated.

OFB is not responsible if you fail to cancel before your next billing date.

6. Refunds

Because OFB provides digital content, memberships, training materials, and online access, refunds are not automatic.

Refund requests may be considered at OFB’s discretion.

Refunds may not be available where content has been accessed, downloaded, consumed, or where a billing period has already begun.

Nothing in this section limits any rights you may have under New Zealand consumer law.

7. Fitness, Nutrition, and Participation Risk

OFB provides general fitness, training, mindset, nutrition, and educational content.

You acknowledge that exercise carries risk and that participation is voluntary.

You are responsible for training within your limits, seeking medical advice when appropriate, and using proper judgement.

Your participation is also governed by the OFB Assumption of Risk & Liability Waiver.

8. Results Disclaimer

OFB does not guarantee any specific result.

Fitness, confidence, body composition, strength, health, performance, income, affiliate commissions, or personal outcomes vary depending on effort, consistency, starting point, health status, experience, lifestyle, and personal circumstances.

Any examples, testimonials, or case studies are not guarantees of future results.

9. Intellectual Property

All OFB content, systems, videos, downloads, PDFs, programs, branding, text, graphics, training material, website content, and related intellectual property remain the property of OFB unless otherwise stated.

You may not:

• Copy, resell, redistribute, or republish OFB content.
• Record, share, or upload OFB members-only content elsewhere.
• Use OFB branding for unrelated businesses.
• Modify or repackage OFB programs as your own.

Your membership gives you personal access only. It does not transfer ownership of OFB content.

10. Affiliate Program

OFB may operate an affiliate program for eligible members.

Participation in the affiliate program is governed by the separate OFB Affiliate Agreement.

Affiliate commissions, eligibility, conduct, tracking, and payout rules are not governed by these Terms except where expressly stated.

11. Privacy

OFB handles personal information in accordance with the OFB Privacy Policy.

By using OFB, you agree that your personal information may be collected, used, and stored as described in that policy.

12. Service Availability

OFB aims to provide reliable access to the website and services, but access may occasionally be interrupted due to maintenance, hosting issues, updates, third-party platforms, internet problems, or technical faults.

OFB does not guarantee uninterrupted, error-free, or permanent access to the website or services.

13. Suspension or Termination

OFB may suspend or terminate access if you:

• Breach these Terms.
• Fail to pay membership fees.
• Share account access.
• Misuse OFB content.
• Act dishonestly, abusively, unlawfully, or in a way that damages OFB.

Upon termination, your access to memberships, dashboards, content, and related services may be removed.

14. Third-Party Services

OFB may use third-party services including payment processors, hosting providers, email services, analytics tools, video platforms, membership software, and affiliate tracking systems.

OFB is not responsible for outages, errors, changes, or failures caused by third-party providers.

15. Changes to These Terms

OFB may update these Terms & Conditions from time to time.

Updated terms become effective when published on the website.

Continued use of OFB after updates means you accept the revised terms.

16. Limitation of Liability

To the maximum extent permitted by law, OFB, its directors, contractors, affiliates, representatives, and related parties shall not be liable for any loss, injury, damage, cost, claim, or expense arising from your use of the website, memberships, training content, services, or participation in OFB programs.

This does not limit any rights you may have under New Zealand law that cannot legally be excluded.

17. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes arising from these Terms shall be subject to the jurisdiction of New Zealand courts.
